1. Agreement to Terms

By using CanKnowPiano, you agree to these Terms of Service. CanKnowPiano is a marketplace connecting piano teachers with students. We do not provide piano lessons ourselves.

Eligibility

You must be at least 18 years old to use this Platform. By using CanKnowPiano, you represent and warrant that you are 18 years of age or older. We do not knowingly collect information from or market to children under 18.

2. For Piano Teachers

Platform Fee Structure

When a teacher registers, they agree:

  • • CanKnowPiano collects the full payment for the First Lesson
  • • The First Lesson fee is our Platform Fee
  • • Teachers keep 100% of all Ongoing Lessons - no commission after first

Example:

First Lesson: Student pays $45 → We keep $45

All future lessons: Student pays Teacher → Teacher keeps 100%

Profile Visibility

When you create a teacher profile, the following location information is publicly visible:

  • Cross streets and street name (without building number)
  • Neighborhood, city, state, and zip code
  • Approximate location coordinates (used for map display and may be visible in page source)

Your full street address and apartment number remain private and are only shared with students after they book a lesson.

Content License

By uploading content to your teacher profile, you grant CanKnowPiano a non-exclusive, worldwide license to display, reproduce, and distribute that content for platform operations and marketing. You retain ownership of your content.

3. For Students

Information Sharing

When you book a lesson, you consent to:

  • Sharing your contact information (name, email, phone) with the teacher
  • Sharing your lesson location address with the teacher (for in-home lessons)
  • The teacher contacting you directly to schedule and conduct the lesson

This information sharing is necessary to facilitate the lesson service you have booked and paid for.

4. Independent Contractor

Teachers are INDEPENDENT CONTRACTORS

  • Teachers set their own schedule and rates
  • We do not supervise teaching
  • The teacher relationship with students is independent

Insurance & Liability

As independent contractors, teachers are responsible for their own business insurance and liability coverage.

We recommend considering:

  • General liability insurance for in-person teaching
  • Professional liability insurance (if required in your state)
  • Auto insurance with business use coverage (if traveling to students)

Important: CanKnowPiano does NOT provide insurance coverage for teachers' professional services, student injuries during lessons, or teacher liability. Teachers are solely responsible for their own insurance decisions and legal compliance. Please consult with an insurance professional to determine appropriate coverage for your teaching business.

Teacher Verification

CanKnowPiano does not verify teacher insurance, credentials, or background. Students are responsible for their own due diligence when selecting teachers.

We recommend:

  • Asking teachers about their insurance coverage
  • Requesting proof of certifications
  • Conducting your own background research

What CanKnowPiano Does NOT Cover:

  • Teacher professional liability or errors
  • Student injuries during lessons
  • Property damage at lesson locations
  • Auto accidents traveling to/from lessons
  • Any claims between teachers and students

5. Limitation of Liability

LIABILITY WAIVER

CanKnowPiano is a marketplace only. We DO NOT:

  • Provide one-on-one piano instruction or lessons
  • Employ or supervise teachers
  • Guarantee lesson quality or outcomes
  • Assume responsibility for teacher-student interactions

Note: We may provide general educational resources (theory guides, technique articles, and music assessments) for informational purposes only.

YOU RELEASE US FROM ALL CLAIMS:

  • Teacher-Student interactions
  • Lesson quality or outcomes
  • Payment disputes
  • Any teacher or student conduct

Maximum Liability: $100

6. Cancellation Policy

All First Lesson payments are NON-REFUNDABLE

Once booked and paid, CanKnowPiano does not issue refunds.

Students:

  • No refunds regardless of cancellation timing
  • Reschedule directly with teacher if needed

Teachers:

  • If you cancel a First Lesson, you must find a qualified substitute teacher at the same rate within 24 hours
  • If you cannot provide a substitute, you must refund the student directly (not through CanKnowPiano)
  • CanKnowPiano does not issue refunds for teacher cancellations
  • Repeated cancellations will result in account suspension

7. Dispute Resolution

Teacher-Student Disputes

We are NOT responsible for disputes between teachers and students. Parties must resolve such disputes directly.

Disputes with CanKnowPiano

Any dispute with CanKnowPiano must be resolved through binding arbitration. By using our platform, you agree to:

  • Resolve disputes individually (no class action lawsuits)
  • Use arbitration instead of court proceedings
  • Accept that arbitration decisions are final and binding
  • Arbitrate under the American Arbitration Association rules

This arbitration agreement survives termination of your account.

8. Data Collection and Privacy

When you register as a teacher and accept these Terms of Service, we automatically collect and store:

  • IP Address: Your device's internet protocol address
  • Browser Information: Your browser type and version (user agent)
  • Timestamp: The exact date and time you accepted our terms

Why We Collect This Information

  • Legal compliance and proof of agreement acceptance
  • Fraud prevention and security
  • Account verification and authentication
  • Dispute resolution

How We Store and Protect This Data

This information is stored securely in our database with industry-standard encryption. We retain this data for the duration of your account and for a maximum of 7 years after account closure for legal compliance purposes.

10. Modifications

We may update these Terms at any time. Continued use after changes constitutes acceptance. We endeavor to notify users of material changes via email.

11. Acknowledgment

BY USING THE PLATFORM, YOU AGREE:

  • ✓ We are a marketplace, not lesson provider
  • ✓ Liability waiver and release of claims
  • ✓ Teachers are independent contractors
  • ✓ Teachers are responsible for their own insurance and legal compliance
  • ✓ Verify your teacher's credentials and background (we don't guarantee quality)
  • ✓ Binding arbitration and no class actions
  • ✓ Collection of IP address and browser info for legal compliance
  • ✓ Public display of profile location information

Teachers:

✓ Platform Fee applies (First Lesson only) ✓ You keep 100% ongoing ✓ Independent contractor ✓ Location info publicly displayed

Students:

✓ Non-refundable First Lesson ✓ We don't guarantee lesson quality ✓ Reschedule with teacher

12. User Content and Intellectual Property

Ownership of Your Content

You retain all ownership rights to content you upload to the Platform, including profile photos, biographies, certifications, and other materials ("User Content").

License Grant

By posting User Content on CanKnowPiano, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and promoting the Platform.

This license ends when you delete your User Content or close your account, except where content has been shared with others and they have not deleted it.

Your Responsibilities

  • You represent that you own or have permission to use all User Content you post
  • You will not post content that infringes any third party's intellectual property rights
  • You will not post illegal, defamatory, or harmful content
  • We reserve the right to remove any User Content that violates these Terms

Platform Trademarks

"CanKnowPiano," our logo, and related marks are trademarks of CanKnowPiano LLC. You may not use these marks without our prior written permission.

13. Copyright Infringement and DMCA Policy

We respect intellectual property rights. If you believe content on our Platform infringes your copyright, please notify us with the following information:

  • A description of the copyrighted work you claim has been infringed
  • The URL or location of the allegedly infringing content on our Platform
  • Your contact information (name, address, email, phone)
  • A statement that you have a good faith belief the use is not authorized
  • A statement that the information in your notice is accurate
  • Your physical or electronic signature

We will investigate and remove infringing content promptly. Repeat infringers will have their accounts terminated.

14. General Provisions

Indemnification

You agree to defend, indemnify, and hold CanKnowPiano harmless from any claims, damages, or expenses arising from your use of the platform or violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CanKnowPiano.

Account Termination

CanKnowPiano reserves the right to suspend or terminate any account at our sole discretion, including for violations of these Terms, fraudulent activity, or conduct that harms the platform or its users.
